These Terms of Service (“Terms”) govern your use of the PlanBuild website and the design-build services provided by PlanBuild by Kamal Companies (“PlanBuild”, “we”, “us”, or “our”). By accessing our website or engaging our services, you agree to be bound by these Terms.

Introduction & Acceptance
Welcome to PlanBuild by Kamal Companies. These Terms of Service constitute a legal agreement between you (the “Client” or “User”) and PlanBuild, governing your use of our website at planbuildbd.com and any design-build services we provide.
By browsing our website, submitting an inquiry, signing a project contract, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or engage our services.
These Terms should be read together with our Privacy Policy, which explains how we handle your personal information.

We collect information in three main ways: information you provide directly, information collected automatically, and information from third-party sources.
PlanBuild / We / Us
PlanBuild by Kamal Companies, based in Chittagong, Bangladesh, along with our employees, contractors, and affiliated entities.
Client / You
Any individual, homeowner, developer, contractor, or organization who accesses our website, requests our services, or enters into a contract with us.
Services
The design, consultation, project management, fabrication, installation, and warranty services we provide, focused on kitchens and bathrooms.
Website
The website at planbuildbd.com and any of its subpages, features, or associated online resources.
Project
Any specific kitchen or bathroom design-build engagement between PlanBuild and a Client, defined by a signed contract or agreed scope of work.
Design Documents
All designs, 3D renders, drawings, layouts, material specifications, and related creative materials produced by PlanBuild for a Project.
Materials
All physical goods, hardware, fittings, cabinetry, tiles, sanitaryware, and appliances supplied as part of a Project.

Use of Our Website
You may use our website to learn about our services, browse project examples, read informational content, and submit inquiries. Any use of our website is subject to the following conditions:
- Personal, non-commercial use: The content on our website is provided for personal and informational use. You may not copy, reproduce, distribute, or use our content for commercial purposes without written permission.
- Prohibited activities: You must not attempt to gain unauthorized access to any part of our website, scrape or harvest data using automated tools, distribute viruses or malicious code, or engage in any activity that interferes with the operation of our website.
- Accurate information: If you submit information through our website (such as through inquiry forms), you agree that the information provided is truthful and accurate to the best of your knowledge.
- Availability: We do our best to keep the website available at all times, but we do not guarantee uninterrupted access. The website may be temporarily unavailable for maintenance, updates, or reasons beyond our control.

Our Services & Scope
PlanBuild specializes in the design and construction of custom kitchens and bathrooms. Our services include, but are not limited to:
- Free initial consultations and site visits within Chittagong
- Custom design and 3D visualization
- Material specification, sourcing, and supply
- Civil work, plumbing, electrical, and waterproofing
- Custom cabinetry fabrication and installation
- Fittings, sanitaryware, and appliance integration
- Project management and quality control
- Post-handover warranty service
What Is Not Included
Unless specifically stated in your project contract, our services do not include:
- Full-home interior design outside of kitchens and bathrooms
- Structural modifications to load-bearing walls or building framework
- Architectural or engineering services requiring licensed professionals not on our team
- Legal, permit, or regulatory approvals (though we assist where possible)
- Post-warranty maintenance, cleaning, or replacements not covered by warranty
Any additional services outside the agreed scope will be discussed, quoted, and approved separately before being undertaken.

Quotes, Contracts & Payment
Quotes & Estimates
All quotes we provide are itemized and detailed. Quotes are valid for 30 days from the date of issue, after which prices may be revised due to changes in material costs, exchange rates, or availability. Verbal quotes are indicative only — formal quotes are always provided in writing.
Contracts
Before any project begins, both parties will sign a written contract detailing the scope of work, materials, timeline, payment schedule, and warranty terms. The contract, together with these Terms, forms the complete agreement between us. Any changes to the contract must be documented in writing and signed by both parties.
Payment Terms
Our standard payment schedule is structured as follows:
- 40% Advance: Payable on contract signing, before work begins
- 40% Milestone Payment: Payable after completion of civil work and waterproofing (for bathrooms) or after cabinet fabrication (for kitchens)
- 20% Final Payment: Payable after project handover and client acceptance
All prices are quoted in Bangladeshi Taka (BDT) and include applicable taxes unless otherwise stated. Payments may be made via bank transfer, mobile financial services, or as otherwise agreed in the contract.
Late Payments
If a scheduled payment is delayed by more than 7 days, we may pause work on your project until payment is received. This pause may affect the overall project timeline. In cases of prolonged non-payment (beyond 30 days), we reserve the right to terminate the contract and recover costs for work already completed.
Transparent Pricing Commitment
Every quote we issue is itemized line-by-line with brand, model, and grade clearly stated. There are no hidden costs or surprise charges. Any changes are quoted and approved in writing before work proceeds.

Timeline, Changes & Delays
Project Timeline
Every project contract includes an estimated timeline with key milestones. Typical timelines range from 3-5 weeks for a bathroom and 4-6 weeks for a kitchen. We commit to reasonable efforts to meet the agreed timeline and provide weekly progress updates.
Change Requests
Changes to the approved design, materials, or scope after work has begun may result in cost adjustments and timeline extensions. All change requests must be:
- Submitted in writing (email, WhatsApp, or signed document)
- Reviewed and quoted before implementation
- Approved by the client before work proceeds
Delays
Delays may occur due to reasons within our control (resourcing, scheduling) or outside our control (client decision delays, material import customs, building society restrictions, weather, or events specified in Section 11). We commit to:
- Notify you promptly of any anticipated delay
- Explain the reason and provide a revised timeline
- Take reasonable steps to mitigate delays within our control
Delays caused by client actions or external factors are not the responsibility of PlanBuild, and do not entitle the client to compensation or refund.

Warranty & Post-Handover Support
Workmanship Warranty
PlanBuild provides a 5-year workmanship warranty on all installations, joinery, and construction work performed under a signed project contract. This warranty covers defects in workmanship arising from our installation and construction, including cabinet joinery, tile installation, and waterproofing (for bathrooms).
Manufacturer Warranties
Materials, hardware, fittings, sanitaryware, and appliances carry their respective manufacturer warranties (typically 5-10 years). Where a warranty claim relates to a manufacturer’s product, we will assist you in coordinating with the manufacturer.
What Is Covered
- Defects in installation and workmanship
- Waterproofing failures resulting from installation defects
- Cabinet joint failures under normal use
- Improper fitting of fixtures or fittings installed by our team
What Is Not Covered
- Normal wear and tear
- Damage caused by misuse, neglect, or unauthorized modifications
- Damage from natural disasters, accidents, or third-party actions
- Cosmetic changes such as color fading due to sunlight or age
- Consumable items (e.g., silicone sealants, filter cartridges)
- Work performed by third parties after handover
Warranty Claims
To claim warranty service, contact us via phone, WhatsApp, or email with details of the issue. Warranty response is typically within 48 hours. We will assess the issue and, where valid, repair or replace at no cost to you. Warranty service is provided only for the original client during the warranty period and applies only to the original installation location.

Client Responsibilities
A successful project requires cooperation from both sides. As a client, you agree to:
- Provide site access: Grant our team access to the property during agreed working hours for measurements, site preparation, and installation.
- Make timely decisions: Provide feedback and approvals within reasonable timeframes at key milestones to avoid delaying the project.
- Make timely payments: Adhere to the agreed payment schedule outlined in your contract.
- Obtain necessary permissions: Secure any building society, landlord, or regulatory approvals required for the work (we will assist where possible).
- Ensure safety arrangements: Take reasonable steps to secure children, pets, and valuables during the construction period.
- Provide accurate information: Share truthful details about the site, existing conditions, and any known issues that may affect the project.
- Communicate concerns promptly: Raise any concerns or observations during the project so we can address them in real time.
Failure to fulfill these responsibilities may impact our ability to deliver the project on time and to specification, and may affect warranty coverage where applicable.

Intellectual Property Rights
Design Documents
All Design Documents (concepts, drawings, 3D renders, material boards, technical specifications) created by PlanBuild remain the intellectual property of PlanBuild until final payment for the project is received. Upon full payment, the client is granted a non-exclusive, non-transferable license to use the Design Documents for the specific project location. Design Documents may not be reproduced, shared with third parties, or used for other projects without written permission from PlanBuild.
Project Photography
PlanBuild retains the right to photograph completed projects for portfolio, marketing, social media, and reference purposes. We will not publish photographs containing personal identifiers (client name, address, family members) without prior written consent. If you prefer that we not photograph or publish your project, please inform us in writing before project completion.
Trademarks & Branding
“PlanBuild” and the PlanBuild logo, along with any associated designs and branding, are the property of PlanBuild by Kamal Companies. You may not use our trademarks or branding without written permission.
Client-Provided Materials
Any references, mood boards, or design inspiration provided by you remain your property. You warrant that you have the right to share such materials with us and that they do not infringe on any third-party intellectual property rights.

Limitation of Liability & Indemnification
Limitation of Liability
To the fullest extent permitted by law, PlanBuild’s total liability arising from or related to any project, service, or use of our website shall not exceed the total amount paid by the client under the specific project contract in question. PlanBuild is not liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of business, revenue, profits, data, or opportunities
- Damages arising from client actions, misuse, or third-party interventions
- Delays or failures caused by events beyond our reasonable control
- Pre-existing conditions of the property not disclosed by the client
Indemnification
You agree to indemnify, defend, and hold PlanBuild, its employees, contractors, and affiliates harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your violation of any law or regulation
- Your infringement of any third-party rights
- Inaccurate or misleading information you provide to us
Nothing in this section limits liability for gross negligence, willful misconduct, or any other liability that cannot be excluded under Bangladeshi law.
- Section 11
Force Majeure & Termination
Force Majeure Events
Neither party shall be liable for delays or failures to perform under a contract due to events beyond their reasonable control, including but not limited to:
- Natural disasters (floods, cyclones, earthquakes)
- War, civil unrest, riots, terrorism
- Government actions, curfews, or regulatory restrictions
- Pandemics, epidemics, or public health emergencies
- Labor strikes affecting the industry
- Failure of utilities, transportation, or supply chains
In case of a Force Majeure event, the affected party will notify the other as soon as reasonably possible. Timelines will be extended by a period equal to the duration of the event. If the event continues for more than 60 days, either party may terminate the contract with written notice.
Termination by Client
You may cancel a project by written notice at any time. In case of cancellation:
- Before design finalization: Refund of paid amounts minus consultation and design fees incurred to date
- After design finalization but before construction: Refund of paid amounts minus design fees and any material orders already placed
- After construction has begun: Payment for all work completed and materials procured; no refund of the value of work done
Termination by PlanBuild
We may terminate a project contract if:
- Payments are delayed beyond 30 days despite reasonable notice
- The client materially breaches these Terms or the project contract
- Site conditions or client actions make it unsafe or unreasonable to continue
- Force Majeure events continue beyond 60 days
In such cases, we will invoice for work completed to date and materials procured.

Governing Law & Dispute Resolution
Governing Law
These Terms and any project contracts are governed by and interpreted in accordance with the laws of the People’s Republic of Bangladesh.
Dispute Resolution
We hope to resolve any disagreements amicably. If a dispute arises:
- Step 1 — Direct discussion: Both parties agree to first attempt to resolve the dispute through direct discussion in good faith.
- Step 2 — Mediation: If direct discussion fails within 30 days, both parties agree to attempt mediation through a mutually agreed neutral mediator.
- Step 3 — Legal action: If mediation fails, the dispute shall be submitted to the courts of Chittagong, Bangladesh, which shall have exclusive jurisdiction.
Notices
Any formal notice under these Terms must be given in writing and sent to the addresses specified in the project contract or via email to admin@planbuildbd.com. Notices are deemed delivered when confirmed as received.
